Court orders Edgar Obare to take down posts about Nairobi Women's Hospital founder Sam Thenya

A court in Nairobi has ordered blogger Edgar Obare to delete published posts about Nairobi Women's Hospital founder Sam Thenya.

The posts, which were found to be defamatory, were published on social media platforms.

Magistrate Becky Cheloti Mulema ordered Obare to immediately pull down the posts published on Instagram, Facebook and Telegram. 

“The respondent is hereby ordered to pull down the articles published on August 19, 2024...defaming the applicant,” she ruled.

She said Thenya's lawyer Cecil Miller had proved that the post were defamatory in nature and highly injurious to his integrity, reputation and character.

“I have examined the affidavit dated September 6, 2024, and I am satisfied that he established a case to warrant the court to grant the prayers sought of pulling down the offending articles circulated in the three social media platforms,” ruled Mulemi.

She also noted that Obare did not present an acceptable explanation as to why he cannot pull down the offending publications.

The court, however, declined to grant a general gag order against Obare, his agents or anyone acting on his behalf from uttering, producing, broadcasting and publishing and or re-broadcasting defamatory information.

“In the absence of an explanation as to why the said offending words were published, there is no basis to refuse to grant the prayer sought.”
