Lawyers demand TikToker Kakan's court appearance, citing constitutional breach

Tiktoker Kakan, known for his politically charged commentary on governance and youth activism, was operating a discreet office under LetaPeleka Logistics before his arrest.
Lawyers representing popular TikToker Godfrey Mwasiage Kakan who was arrested by detectives at his shop on Kimathi Street on Wednesday have threatened to file a habeas corpus application if police fail to present him in court.
One of his lawyers Philip Biko Maiyo said Mr Kakan should have been presented at the Kahawa Law Courts on Thursday but failed to appear contrary to legal provisions that require an arrested person to be brought to court no later than the day after their arrest.
“I spoke with Kakan at Muthaiga Police Station in the morning and he informed me that he would be taken to Kahawa Law Courts. Several lawyers were already waiting for him at the court but by evening, the police had not brought him,” Mr Maiyo said.
Mr Kakan’s arrest has drawn national attention including from the Law Society of Kenya (LSK), which has joined the legal team demanding his immediate appearance in court.
Yesterday morning, the Directorate of Criminal Investigations (DCI) confirmed Mr Kakan's arrest via its official X account.
The TikTok content creator had been operating out of Kimathi House under a business registered as LetaPeleka Logistics.
“The suspect behind a viral video inciting violence against police officers and their families has been arrested. The video had been uploaded to his TikTok account,” the DCI said.
“Detectives trailed the suspect to Kimathi House where he was operating a discreet office under the name LetaPeleka Logistics. He is currently in custody undergoing processing, pending arraignment,” the statement added.
Mr Kakan is known for his politically charged content on TikTok and X where he frequently shares unfiltered commentary on governance, youth activism and state accountability. His popularity has surged amid the recent wave of anti-government protests.
